Dave's Surplus is dedicated to offering quality new and used merchandise at incredibly low prices. Because we operate within the surplus industry, we often find that we cannot always replenish diminishing stock with identical items. Even though we do try to maintain popular lines of merchandise, changes in supply quality, availability of merchandise, or discontinued manufacture may prevent us from doing so. It's for this reason that we can't guarantee to meet special requests, but the Dave's Surplus family promises to keep your needs in mind when buying new merchandise.

Fees and Restrictions
In order to be better able to serve you, there may be additional handling fees or minimum order quantities required for particular items. These will be described on the page where the item appears, along with explicit instructions for ordering.
There are always standard handling charges applied to any order; see the table of standard handling charges.
Please pay careful attention to any disclaimers or special restrictions noted in the description of an item. These will usually be presented in larger or bolder type, or in a different color than the rest of the text. A flashing graphic may also be included to attract your attention to the message.

If sale of a particular item carries special restrictions, if quantities are limited, or if a special condition exists (such as a damaged packaging situation or requirement for motor freight for transport), you will find it presented in larger or bolder type, or in a different text color than the rest of the description.
Orders may be made by secure shopping cart, phone, fax, snail mail, FedEx, UPS, courier, email, etc. When ordering, please include your name (required), daytime phone number (required), preferred method of payment, and shipping address (required). If you won't include this information, we cannot help you. We must be able to reach you by phone to finalize your order. We must have a shipping address to obtain a shipping estimate for you*.
All merchandise will be sold on a first-come-first-served basis. Web customers will be ranked on the basis of date we receive your order regardless of the means used to transmit it. Dave's Surplus, Inc., cannot be held responsible for delays in the receipt of orders as the result of failure on the part of a third-party, including email servers or delivery services.
Reserving Merchandise
Upon receipt of your order, the merchandise you have requested will be reserved, and cannot be sold to other Web customers or in-store customers. Dave's Surplus, Inc., will send you confirmation of your order--including price of merchandise, shipping, handling. A hard-copy invoice can be sent by regular post on the same date at your request. Merchandise will be shipped to you within 24 hours of receipt of payment. See also Revocation of Merchandise Reservation.

Merchandise will be shipped within 36 hours of receipt of your payment. In some cases, shipment may be delayed until funds are cleared.
Revocation of Merchandise Reservation
If the customer cannot be reached to confirm his/her order by phone or fax within three business days of receipt of your order, Dave's Surplus reserves the right to revoke the customer's merchandise reservation and may then use the merchandise to fill other confirmed orders, as appropriate.
If payment is not received within ten business days of the date on which confirmation of your order was sent, and no notification is received by Dave's Surplus regarding the nature of the delay, Dave's Surplus reserves the right to revoke the customer's merchandise reservation and may then use the merchandise to fill other confirmed orders, as appropriate.
If, after receiving confirmation of your order, the customer changes his/her mind and declines to complete the sale, the customer is expected to promptly notify Dave's Surplus of this change so as not to inconvenience other customers who may be waiting to purchase the item(s) under consideration.
All time periods described in the foregoing exclude U.S. national holidays.

Shipping charges are posted for each item. These are for shipping within the lowers 48 United States. All other should call for a shipping estimate.
Dave's Surplus uses U.P.S. to ship merchandise, and passes the shipping charges on to the customer without surcharge.
The customer's needs and deadlines will be accomodated as fully as possible. If, however, Dave's Surplus cannot reach the customer with the estimate (or receives no reply from the customer regarding the estimate) by the date and time required for shipping, the shipment will be withheld until approval of the charges can be obtained. If you wish to waive your right to approve these charges and have your merchandise shipped without explicit approval of the shipping charges, please state this when you order. Because we are licensed in the State of Delaware, there is never any sales tax when purchasing from Dave's Surplus.
Dave's Surplus will do everything we can in every instance to ensure that you know what you are ordering and that it will meet your needs. A change of mind on the part of the customer or decision by the customer that the merchandise is not what they thought it would be is not sufficient grounds for a return. We cannot accept returns based on these grounds. We will do everything we can to ensure that you know what you are getting before you order. You must do your part to ensure that you understand what you are ordering before we ship it.
We guarantee that the merchandise is intact and in working order when it ships, and that it meets the description offered for the item. Any exceptions will be explained to you before your order is finalized.
If you receive an item that exhibits damage not previously described to you or whose packaging appears to have been tampered with, or if you do not receive your shipment within the timeframe promised, please call us within 10 business days of the date of receipt (or the date of expected receipt). We will call you immediately and try to rectify the situation. If no better solution can be achieved, we can refund the purchase price of the merchandise or offer you credit towards other goods. In most cases without third party responsibility when Dave's Surplus is in part or in full responsible for the error, we will also refund transportation costs. In all cases with third party responsibility, we will ensure that your transportation costs are refunded by the carrier. Sorry, we cannot refund handling charges.
If we do not hear of any situation within 10 business days of the anticipated date of receipt, we will consider the matter closed. Complaints received after that time regarding the state of the merchandise will not be considered.
In other words, inspect your merchandise as soon as you receive it, and keep all packaging materials until you are satisfied that the merchandise is in proper condition.
Our Spam and Junk
Email Policy
Dave's Surplus doesn't like spam any more than you
do. We will never sell or give away your contact information to
anyone for any purpose.
Sometimes a customer has a special request or is not sure that an item is exactly what they need. We find in these cases that it is easier and much quicker to discuss the customer's needs by phone. The alternative is to send suggestions via email for the customer's approval. This can take weeks to find something that meets the customer's needs...as opposed to several minutes on the phone.
Likewise with your shipping address: we can't get an accurate shipping estimate without your address, and we obviously can't ship anything to you without the address.
Dave's Surplus maintains mailing lists for some of our merchandise. If you make an inquiry for an item that is out of stock, your name is added to a list for that product. This enables us to contact you quickly if the status of the product changes or if new merchandise becomes available. We will always tell you when we add you to a list. We will never sell these lists or give them away to anyone. If you do not want to be notified when a product's status changes, you must tell us to remove you from the list. Our mailing lists will never be used to send you sales pitches or notification about items you don't want. You will only receive updates on items you have written about. If you ever receive mail from us about something you're not interested in, please tell us immediately so that we can correct the mistake.
